The Utah Legislature will need to rapidly redraw the state’s congressional boundaries after a judge ruled Monday that the Republican-controlled body circumvented safeguards put in place by voters to ensure districts aren’t drawn to favor any party.The current map, adopted in 2021, divides Salt Lake County — Utah’s population center and a Democratic stronghold — among the state’s four congressional districts, all of which have since elected Republicans by wide margins. District Court Judge Dianna Gibson made few judgments on the content of the map but declared it unlawful because lawmakers had weakened and ignored an independent commission established by voters to prevent partisan gerrymandering. “The nature of the violation lies in the Legislature’s refusal to respect the people’s exercise of their constitutional lawmaking power and to honor the people’s right to reform their government,” Gibson said in the ruling.New maps will need to be drawn quickly, before candidates start filing in early January for the 2026 midterm elections. The ruling gives lawmakers a deadline of Sept. 24 and allows voting rights groups involved in the legal challenge to submit alternate proposals to the court.But appeals expected from Republican officials could help them run out the clock to possibly delay adopting new maps until 2028.Redistricting battle could shift the balance in CongressThe ruling creates uncertainty in a state that was thought to be a clean sweep for the GOP as the party is preparing to defend its slim majority in the U.S. House. Nationally, Democrats need to net three seats next year to take control of the chamber. The sitting president’s party tends to lose seats in the midterms, as was the case for President Donald Trump in 2018.Trump has urged several Republican-led states to add winnable seats for the GOP. In Texas, a plan awaiting Gov. Greg Abbott’s approval includes five new districts that would favor Republicans. Ohio Republicans already were scheduled to revise their maps to make them more partisan, and Indiana, Florida and Missouri may choose to make changes. Some Democrat-led states say they may enter the redistricting arms race, but so far only California has taken action to offset GOP gains in Texas.CongressAug 21How redistricting is done and why it could give parties an edge in 2026 electionsElectionsAug 23Texas Senate passes new Republican-drawn congressional mapThe U.S. Supreme Court is unlikely to intervene, and the Utah Supreme Court may be hesitant to entertain an appeal of Monday’s ruling after it had sent the case back to Gibson for her to decide. The nation’s high court in 2019 ruled that claims of partisan gerrymandering for congressional and legislative districts are outside the purview of federal courts and should be decided by states.Voting rights groups celebrate legal victoryDavid Reymann, an attorney for the voting rights advocates who challenged the map, called the ruling a “watershed moment” for the voices of Utah voters.“The Legislature in this state is not king,” Reymann told reporters Monday evening.Leaders from the Democratic National Committee and the Democratic Congressional Campaign Committee applauded the ruling as a victory for democracy.Republican Gov. Spencer Cox said he disagrees with the decision but holds respect for Utah’s judiciary. Meanwhile, the state’s GOP Chairman, Robert Axson, dismissed the ruling as “judicial activism.”Utah’s Republican legislative leaders, Senate President Stuart Adams and House Speaker Mike Schultz, said in a joint statement that they are disappointed by the ruling and are carefully considering their next steps. In 2018, voters narrowly approved a ballot initiative that created an independent redistricting commission to draw boundaries for Utah’s legislative and congressional districts, which the Legislature was required to consider. Lawmakers repealed the initiative in 2020 and replaced it with a law that transformed the commission into an advisory board that they could choose to ignore.The following year, lawmakers disregarded a congressional map proposal from the commission and drew one of their own that carved up Salt Lake County among four reliably Republican districts.Voting rights advocates sued, arguing the map drawn by lawmakers constituted partisan gerrymandering that favored Republicans. They also said the Legislature violated the rights of voters when it repealed and replaced the 2018 initiative.The case made its way to the Utah Supreme Court, which ruled that the Legislature cannot change laws approved through ballot initiatives except to reinforce them, or to advance a compelling government interest. The five-member panel sent the case back to Gibson in the lower court to decide whether lawmakers would have to redraw boundaries set as part of a redistricting process that happens every 10 years.Lawmakers and voters clash over redistrictingThe ruling Monday reinstates the voter-approved redistricting standards that lawmakers had overturned. Utah was one of four states where voters approved measures designed to reduce partisan gerrymandering in 2018. As in Utah, Missouri’s Republican-led Legislature quickly sought to repeal key provisions. Missouri voters approved the Legislature’s revisions in 2020, before the original plan was ever used. Independent commissions approved by Colorado and Michigan voters remained in place and were used after the 2020 census.The redistricting measures aren’t the only instances where state lawmakers have altered voter-approved measures. Earlier this year, Missouri lawmakers repealed a paid sick leave law passed by voters and referred a proposed repeal of an abortion rights amendment to the ballot. In South Dakota, voters approved a public campaign finance system, tightened lobbying laws and created an ethics commission in 2016. The sight of masked federal agents in tactical gear descending on Home Depots across Southern California is forcing undocumented day laborers to weigh earning badly needed income against the risk of being arrested or deported.At least two Home Depot parking lots in the Los Angeles area were targeted Friday amid the Trump administration’s immigration crackdown. Day laborers were detained in North Hollywood and Alhambra as organizers shouted demanding to see warrants and attempted to obtain as much information as possible from handcuffed workers.The scene has become familiar this summer to day laborers, who are desperate to maintain a steady income in a local economy still recovering from January’s wildfires and the rising cost of building materials caused by tariffs.They wait in parking lots each morning, hoping to earn a day’s wage or, if they’re lucky, get hired for a long-term project that could mean weeks or months of steady pay. But the constant threat of arrest is taking a toll on many workers, who say they are traumatized and can’t sleep after watching friends and family members being arrested and taken to jail. “What can you do? In this country you can’t stay home. You need money for kids, bills, rent, food,” said Arturo, a day laborer who lives in Los Angeles and spoke in Spanish. Arturo and other laborers interviewed by NBC News spoke on the condition of anonymity because they feared being targeted by Immigration and Customs Enforcement agents or other federal officers. He ran onto a nearby freeway and was hit by a car. Immigration advocates and community members said Montoya, who was in the U.S. without legal authorization, was not a criminal but a hardworking father.“He came here to work hard. My uncle was not a criminal,” his niece, Mariela Mendez, told mourners during a vigil last week for Montoya. “He wanted what a lot of us want: a better life.”The Department of Homeland Security said Montoya was not being pursued by federal agents when he died.Home Depot declined to comment on his death or say how many arrests have occurred on its properties. “We aren’t notified that ICE activities are going to happen, and in many cases, we don’t know that arrests have taken place until after they’re over,” the Atlanta-based company said in an emailed statement. “We’re required to follow all federal and local rules and regulations in every market where we operate.”Sitting in his truck parked close to where Montoya started running, Jose quietly sobbed as he looked at the small tree where his friend used to lock up his bike every morning. Jose said he had known Montoya for about five years and described him as friendly and chatty with the other workers who assembled every morning in the parking lot.On the day Montoya died, Jose said he arrived a few hours later than usual and was confused by all the commotion. Helicopters roared overhead and traffic came to a standstill.“It’s like it happened to all of us,” he said in Spanish through tears. “We all know each other. We’re all the same.”Jose said that returning to the scene of Montoya’s death was heartbreaking, but his choices were limited. He needs to work, and the idea of not earning money every day keeps him up at night. “He wasn’t a criminal. He wasn’t a bad guy,” Jose said, adding that he doesn’t understand why Montoya ran onto the freeway. “I wish he had taken his chances with an immigration judge.” A few paces away, Felipe stood in the shade of a tree, waiting for someone to hire him. He has lived in the U.S. since 2015 andworked in restaurants until the Covid pandemic crippled the industry, he said. He has returned to this Home Depot most days for five years, but the opportunities have dried up, he said. First it was the wildfires, then it was the tariffs and now it’s the fear of immigration enforcement. Felipe remembers a time when he could pick and choose which jobs to do on which days. Now, he’s lucky to be hired even for a few hours. “Thank God I wasn’t here when they got Carlos,” he said. “I’d be in Mexico without clothes.” When asked about the last time he saw Montoya, Felipe pointed to the little tree nearby. “He was sitting there talking with somebody,” Felipe said. “He seemed happy.”Nancy Meza, an organizer with the National Day Laborers Organizing Network, works with dozens of volunteers stationed at Home Depots across Southern California. They patrol parking lots and street corners, watching for incoming signs of immigration enforcement activity. When spotted, volunteers signal each other in a group chat and shout warnings to nearby workers.Meza said she hears a mix of stress and determination from day laborers. Many vow to continue working for a sense of normalcy and to maintain a steady income, despite the personal cost.“There’s a feeling of, ‘If we stay home and just sit back in fear, it makes things worse, we feel really anxious, powerless,’” she said. “They would rather take their chances.”Anti-ICE activists march through the Home Depot in Pasadena on August 6, 2025. Sharon Nicholls, who leads the Anti-ICE activists, later read a letter to the store manager requesting that Home Depot protect day laborers at their facility.Standing outside a different Home Depot on a blistering hot day, Arturo said he has lived in the United States for 25 years and regrets not learning English or trying to become a citizen. When he first arrived, he said, he was too embarrassed to attend night classes covered in sweat and paint after a day’s work. The citizenship process also is costly and time-prohibitive, he said, noting that many of his friends who managed to obtain lawyers and go through the process said it cost them some $15,000 and nearly a decade of waiting. Arturo thought his time would be better spent earning money so he could leave sooner. Like many undocumented people, Arturo intended to return home to Mexico within a few years of arriving. But he fell in love and had two children. They are now teenagers and he can’t leave them behind, he said. If he took them to Mexico, he worries they would feel too out of place in a country they have never visited. Instead, he encourages them to study hard and attend college. To help make that happen, he works six days a week, leaving Sundays open to spend with his children and attend church.He said the benefit of what he is doing outweighs the risk.“All you can do is work to survive,” he said. “Immigration or no, people come out because they have to eat.”
